Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of OrbFit websites, the Orbital Outpost store, the OrbFit athlete app (including progressive web and native wrappers when available), programs, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Who we are

OrbFit provides structured conditioning programs, digital training tools, and a marketplace for programs (“Orbital Outpost”). Contact and notices related to these Terms may be directed through channels published on the OrbFit site.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or purchase programs. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

4. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms or that create risk to other users or the platform.

5. Training disclaimer — not medical advice

OrbFit content is for general fitness and conditioning education only. It is not medical advice, diagnosis, or treatment, and is not a substitute for professional medical care. Obtain medical clearance when appropriate before starting a program. Stop training and seek care for chest pain, faintness, severe shortness of breath, or sharp and persistent pain. You assume all risks associated with physical activity.

6. Programs, purchases, and access

Programs and digital goods sold through Orbital Outpost are licensed for personal use by the purchasing account unless otherwise stated. Purchases may unlock content in the athlete app through the shared catalog and entitlement system. Prices, availability, and included materials may change. Except where required by law or expressly stated at purchase, digital program sales are final once access is delivered.

7. Subscriptions (including Orbital Multipass)

If you purchase a subscription, billing continues on the stated cycle until you cancel according to the method shown in your account or store. Taxes may apply. Features labeled “coming soon” are not guaranteed for any specific date.

8. Acceptable use

You agree not to:

• Copy, resell, scrape, or publicly redistribute program content without permission
• Interfere with security, reverse engineer non-public systems, or abuse APIs
• Impersonate others, harass users, or upload unlawful or harmful content
• Use the Services for any purpose that violates applicable law

9. Intellectual property

OrbFit branding, logos, UI, software, and original program materials are owned by OrbFit or its licensors. Coach- or third-party-published programs remain subject to their stated licenses and platform rules. You retain rights in content you create (such as journal notes), and grant OrbFit a limited license to host and process that content to operate the Services.

10. Coaches and third-party programs

When coaches publish programs on Orbital Outpost, they are responsible for the accuracy and safety of their content and for any claims they make. OrbFit may remove listings that violate these Terms or applicable law. Platform fees and payout terms for coaches will be disclosed separately when the coach portal is available.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee specific fitness results, uninterrupted service, or error-free operation.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBFIT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ORBFIT FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

13. Indemnity

You will defend and indemnify OrbFit against claims arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

14. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after the effective date constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction require otherwise.
